How Long Do Families Have to File a Wrongful Death Claim in Seguin, TX?

In Seguin and throughout Texas, families generally have two years from the date of death to file a wrongful death claim under Texas law. Missing this filing period can prevent the case from moving forward in court unless a legal exception applies.

In certain situations, a claim involving a government agency may require written notice within six months. Local rules can impose shorter notice periods, so the required deadline may depend on the public entity involved.

To start the process, the surviving spouse, children, or parents may bring the wrongful death claim. If none of them files within three months, the estate’s executor or administrator generally must pursue it unless all eligible relatives ask otherwise.

Depending on the family’s losses, compensation may include lost financial support, loss of care and services, loss of companionship, mental anguish, and funeral expenses. The amount available depends on the losses established through the claim.

Beyond the wrongful death claim, the estate may bring a survival claim for losses the person experienced before death. Those losses may include medical expenses and other damages tied to the period between the injury and death.

Once the deadline passes, a court will usually dismiss a late wrongful death claim unless an exception applies. That can leave the family without a court remedy for losses that otherwise could have been pursued.

Because the filing deadline can pass quickly, a wrongful death lawyer can review the timeline and confirm how long your family has to file. An attorney can also explain who may bring the claim and prepare the required documents on time.
