Who Can File a Wrongful Death Claim in Jefferson County, TX?

In Texas, a surviving spouse, children, or parents can file a wrongful death claim. One eligible family member may file on behalf of everyone who qualifies, allowing their losses to be addressed in a single lawsuit.

If no eligible family member files a claim, the estate's executor or administrator generally must do so after three calendar months unless all eligible family members request otherwise.

Depending on your family's losses, a wrongful death claim may cover lost financial support, mental anguish, and loss of companionship. What your family may recover depends on the circumstances of your loved one's death.

When responsibility for a fatal crash is disputed, crash reports, photos, vehicle damage, and available video can help show what happened. Preliminary findings from investigators do not necessarily determine who is legally responsible.

Under Texas law, you generally have two years from your loved one's death to file a wrongful death lawsuit. Some exceptions may apply, so it is important to understand which deadline applies to your family's case.

If there is a disagreement about who can file a wrongful death claim, a wrongful death lawyer can review the circumstances and explain who is eligible under Texas law. An attorney can also prepare the necessary paperwork and handle insurance matters on the family's behalf.
