What Compensation May Be Available After a Pedestrian Crash in Plano, TX?

A pedestrian injured after being struck by a vehicle in Texas may be eligible to seek compensation if a driver's negligence contributed to the collision. The available legal options depend on the circumstances of the crash, the injuries involved, and the insurance coverage available.

A personal injury claim may include medical expenses, rehabilitation costs, lost wages, reduced earning capacity, and pain and suffering. If the injuries require continued treatment or affect the person's ability to work, future medical expenses and other long-term losses may also be considered.

Determining fault may involve reviewing the driver's actions, the pedestrian's location, visibility, roadway lighting, traffic conditions, and other circumstances. Evidence such as photographs, witness statements, vehicle damage, available surveillance footage, and the official crash report may help establish how the collision occurred.

Texas follows a modified comparative responsibility system. An injured person may recover compensation if their percentage of responsibility is not greater than 50 percent. Any potential recovery may be reduced according to their share of fault.

People involved in pedestrian crashes should keep medical records, bills, treatment recommendations, and documentation of missed work. These records can help establish the financial and personal losses connected to the collision. Insurance coverage and applicable filing deadlines should also be considered.
