What Compensation Can I Recover After a Car Accident in Shelbyville, TX?

After a car accident in Shelbyville, you may be able to recover compensation for your medical bills, future treatment, lost wages, reduced ability to earn, pain and suffering, and vehicle repairs. How much you can recover depends on your injuries, your costs, and how the crash has affected your daily life.

In Texas, your personal injury protection (PIP) coverage can help pay eligible medical expenses and lost income no matter who caused the crash. This coverage is included in your auto policy unless you rejected it in writing, and payments are limited to the amount your policy provides.

Every claim is different. Its value often depends on how serious your injuries are, how long your treatment lasts, and how much insurance coverage is available. Medical records and proof of missed work can help show your actual losses instead of relying on estimates.

If the insurance company says you were partly at fault, Texas law may reduce your compensation by your percentage of fault. If you are found more than 50 percent responsible, you generally cannot recover anything, so strong evidence matters when the drivers' accounts of the crash differ.

In rare cases, a court may award additional damages if it is proven that the other driver acted with extreme recklessness. These damages are meant to punish serious wrongdoing, and Texas law limits when they can be awarded and how much.

Under Texas law, you generally have two years from the date of the car accident to file a personal injury lawsuit. If you miss this deadline, you may lose your right to seek compensation through the courts.

Before you accept a settlement offer, a car accident lawyer can review your medical costs, lost income, available insurance coverage, and the details of the crash. An attorney can also help you decide whether the offer fairly covers your injuries.
