Who Can File a Wrongful Death Claim in Plano, TX?
In Plano and throughout Texas, a wrongful death claim can be filed by a spouse, children, or parents. These relatives may seek compensation when another party's actions caused the death.
Although one family member can file, the case can be brought on behalf of all eligible family members, and they may choose to file together. Any payment is divided according to each person's loss rather than just the person filing.
If none of them file within three months, the person handling the estate may be able to bring the claim unless the eligible family members ask otherwise. This provides another option for families.
In addition to a wrongful death claim, the estate may bring a separate claim for medical expenses or suffering the person experienced before death. Payment for those losses goes to the estate and follows different rules from the family's compensation.
Through a wrongful death claim, your family may be able to recover lost financial support, loss of care and companionship, mental anguish, and loss of inheritance. Funeral and burial expenses may be available through an appropriate claim, depending on the facts and who paid them.
Under Texas law, families generally have two years from the date of death to file a wrongful death lawsuit. Some situations have different deadlines, so gathering essential records early can help your family understand the time available.
As insurance questions arise, a wrongful death lawyer can explain who may file and who may benefit from the claim. Legal guidance can also help your family evaluate offers and address disagreements.
