How Are Wrongful Death Claims Handled After a Fatal Highway Crash in Houston, TX?

When a fatal highway crash occurs in Texas, eligible family members may have the right to pursue a wrongful death claim if another party’s negligence caused the loss. These claims can help address financial and personal losses, but the process depends on the evidence, insurance coverage, and circumstances of the crash.

Under Texas law, a wrongful death claim may generally be brought by the deceased person’s surviving spouse, children, or parents. A separate survival claim may also be pursued on behalf of the estate for certain claims the deceased person could have brought had they survived. The claims serve different purposes, and eligibility depends on the circumstances.

Investigators may examine vehicle damage, roadway evidence, witness statements, available video footage, and other information to determine how a crash occurred. In a collision involving a vehicle fire, evidence about the sequence of events and the cause of the fire may also be relevant. Families should avoid assuming that the cause has been established before the investigation is complete.

Potential damages in a wrongful death case may include lost financial support, loss of companionship, mental anguish, and other losses recognized by law. A survival claim may address certain damages associated with the deceased person’s own injuries and losses before death. The types and amount of recoverable damages depend on the facts and applicable law.

Insurance coverage is another important consideration. Depending on the circumstances, compensation may be available through a responsible driver’s liability policy or other applicable coverage. Multiple parties or policies may need to be evaluated before the available options are clear.

Texas generally sets a two-year deadline for filing wrongful death and survival lawsuits, although exceptions may apply. Preserving relevant documents, insurance information, and communications can help families understand their options and avoid unnecessary delays.
