What Compensation Can Families Recover After a Fatal Crash in Killeen, TX?

After a fatal crash in Killeen, families may be able to recover compensation for lost financial support, companionship, and care. Other damages may include mental anguish, lost inheritance, and funeral expenses. The amount depends on the family's circumstances and the losses involved.

In Texas, a wrongful death claim can be brought by the surviving spouse, children, or parents. These family members may file individually or together. If none files within three months, the executor or administrator generally must file unless all eligible family members request otherwise.

Every family's loss is different, and several factors can affect the value of a claim. These include the deceased person's age, health, income, and expected future earnings. Their role in supporting and caring for family members may also be considered.

Under Texas law, families generally have two years from the date of death to file a wrongful death lawsuit. Certain exceptions may affect this deadline. Missing the applicable filing period could prevent your family from pursuing the claim.

When a fatal accident raises questions about insurance coverage or who was responsible, a wrongful death lawyer can review the evidence and explain your family’s legal options. An attorney can also communicate with insurance companies and help with the paperwork needed to pursue a claim.
