Who May Bring a Wrongful Death Claim in Brazos County, TX

Texas law decides which family members can bring a wrongful death claim, and the list is narrower than many people expect. Under Texas Civil Practice and Remedies Code, the surviving spouse, children, and parents of the person who died may file, and a single claim is brought for the benefit of all of them. Siblings and other relatives are not included, even when they were close to the person.

The estate has its own separate survival claim, which covers losses the person experienced before death, such as medical bills, conscious pain, and funeral costs. Since the survival claim and the wrongful death claim cover different losses and go to different recipients, a wrongful death lawyer in Bryan may help a family work out who should file which one.

If none of the eligible relatives files within three months of the death, the executor or administrator of the estate may bring the wrongful death claim unless those relatives ask that it not be filed.

Texas generally gives families two years from the date of death to file, and that clock can keep running while relatives handle funeral arrangements and an estate. Marriage records, birth certificates, and letters of administration are typically needed to show who qualifies to file.
