How Texas Wrongful Death Claims Work in Armstrong County, TX
Texas law lets certain family members seek compensation when a person dies because of someone else's wrongful conduct. Under the state's wrongful death statute, the claim belongs to the surviving spouse, children, and parents of the person who died.
If none of these family members file within three months, the personal representative of the estate may bring it, unless those family members ask that it not be filed.
Families should take into account the time limit that Texas sets to bring this claim. Texas generally gives two years from the date of death to file, and a missed deadline can bar the claim altogether.
Evidence can fade well before the two years, since vehicles may be repaired or released and witness memories can change. Damages in these claims may include lost financial support, loss of companionship, and mental anguish, depending on the circumstances.
A separate survival action covers losses the person experienced before death, such as medical bills, conscious pain, and funeral costs, and the estate's representative brings it. Many families turn to a wrongful death lawyer to help them identify which claims apply, coordinate the family and estate filings, and gather records from every source.
