According to the Seguin Police Department, a 2012 Kia Sorento was heading south on State Highway 46 at a high rate of speed when the driver lost control. The SUV crossed into the northbound lanes and hit a guardrail. Both men, ages 20 and 23, died at the scene. Officials have not said who was driving.
Northbound and southbound lanes were closed for several hours while crews cleared the scene. Both men had ties to the university's football program, and Texas Lutheran University has planned a memorial service for Thursday, November 5.
The crash remains under investigation.
We extend our deepest condolences to the families and loved ones of the two young men who lost their lives.
Who Can File a Wrongful Death Claim in Seguin, TX?
In Seguin and throughout Texas, a wrongful death claim can be filed by a surviving spouse, child, or parent of the person who died. The right to file depends on your relationship to your loved one.
If none of them file within three months, the estate's personal representative may bring the wrongful death claim. Eligible family members can prevent that filing by asking the representative not to proceed. Their wishes can affect whether the estate proceeds.
In addition to a wrongful death claim, the estate may have a separate survival claim. This addresses losses your loved one experienced before death, including medical expenses and pain. Any recovery belongs to the estate.
Through a wrongful death claim, your family may qualify for compensation for lost financial support, companionship, care, mental anguish, lost inheritance, and funeral costs. The amount depends partly on your loved one's place in the family.
Under Texas law, families generally have two years from the date of death to file a wrongful death lawsuit. Missing this deadline can make it impossible to pursue the claim in court.
During the claims process, a wrongful death lawyer can go over the investigation findings, insurance issues, and legal options available to your family. An attorney can also explain who may bring the claim and what steps it requires.
