What Compensation May Be Available After a Serious Crash in Del Valle, TX?
People injured in a serious vehicle crash in Del Valle may be eligible to pursue compensation for medical expenses, lost income, vehicle damage, and other losses. Whether compensation is available depends on the evidence, the extent of the injuries, insurance coverage, and the legal responsibility of those involved.
Medical expenses may include emergency care, hospital stays, diagnostic testing, surgery, medication, rehabilitation, and follow-up appointments. Medical records, bills, and treatment recommendations can help document expenses already incurred and potential future care needs.
Lost income may also be recoverable when injuries prevent a person from working. Pay records, employer statements, and documentation of missed work can help establish these losses. If an injury affects a person's future ability to earn income, that potential loss may also be relevant. Depending on the facts, a claim may include compensation for pain and suffering as well.
Evidence can help clarify how the crash occurred and who may be responsible. Relevant materials may include photographs of the vehicles and roadway, witness accounts, available camera footage, vehicle damage records, and the official crash report.
Texas generally follows a modified comparative responsibility rule. An injured person may recover damages if their share of responsibility does not exceed 50%, although any award may be reduced according to their percentage of fault. The application of this rule depends on the specific facts and evidence.
Legal deadlines may restrict the time available to file a claim, so reviewing the applicable time limits can help preserve potential options.
