How Long Do You Have to File an Injury Claim in Chappell Hill, TX?
Texas generally gives injured people two years from the date of the injury to file a personal injury lawsuit. That deadline comes from the state's civil practice code, and a claim filed after it has passed is usually dismissed. Wrongful death claims also carry a two-year deadline, counted from the date of death.
Delay can weaken a claim well before that deadline arrives. Witnesses may move away from the scene or forget details. Security video from nearby businesses is commonly overwritten on a short cycle. Long gaps in treatment records can also invite questions from insurers.
Several exceptions can change the timeline. For minors, Texas law generally pauses the two-year clock until the person turns 18. Claims where a government vehicle or a public employee is involved can require written notice within six months or less, depending on the entity involved.
The exact deadline depends on the facts, so many people ask a car accident lawyer to review the date of injury, check for exceptions, and calendar the filing date.
