What Legal Rights Does a Family Have After a Fatal Hit-and-Run in San Antonio, TX?

When a loved one dies in a hit-and-run crash, surviving family members may have legal options for pursuing compensation, even if the driver has not yet been identified.

Under Texas law, eligible family members may bring a wrongful death claim when another person’s wrongful act, neglect, carelessness, or lack of skill causes a death.

A driver who leaves the scene after striking a pedestrian may face criminal consequences, but a criminal investigation is separate from a civil claim. Investigators may examine witness statements, nearby surveillance footage, vehicle damage, and other evidence to identify the driver. If the driver is located, the family may be able to pursue a claim against that person and potentially applicable insurance coverage.

If the driver cannot be found or lacks sufficient insurance, certain policies may provide another avenue for recovery. For example, uninsured motorist coverage may apply to some hit-and-run incidents, depending on the policy language and legal requirements. Families may wish to review available household auto insurance policies to determine whether coverage could be relevant.

Texas wrongful death claims may allow eligible family members to seek damages for losses such as lost financial support, loss of companionship, and mental anguish. A separate survival claim may also be available through the deceased person’s estate for certain damages the person could have pursued before death.

Texas generally imposes a two-year statute of limitations on wrongful death claims, although exceptions may apply. Insurance policies can also contain notice and evidence requirements, so preserving records and seeking guidance promptly may help protect potential claims.
